Clinic to Dr. Rima: No Cataract Surgery for YOU, Resister!
Last week I shared the story of my bid to have elective cataract surgery done without inaccurate and socially dangerous COVID-19 testing. “No dice”, said Catalina Surgery Center, believing that they somehow had the right to nullify my protected Right of Informed Consent. They don’t.
After I submitted an Informed Consent refusal letter, with a letter signed by a licensed medical professional (read here: http://www.opensourcetruth.com/dont-want-covid-vaxx-refuse-testing/) stating that I was excused from COVID-19 PCR testing prior to my elective eye surgery, the Managing Board of the Catalina Surgery Center sent back the following reply:
Oddly, they seem to believe that they have the right to do that.
I disagree and sent the following letter back to them:
Thank you for our email with the attached letter telling me that your facility has chosen to refuse to allow me to exercise my protected Right of Informed Consent in declining COVID-19 testing. As a ratifying nation of the Geneva Convention, the United States has adopted into its law the position of the Geneva Convention on the Right of Informed Consent. This Right may not be abrogated by any authority contained within the United States, including State Governors or surgical centers.
If you wish to reconsider your decision and reschedule an appointment time for each of my two eyes surgeries, please let me know. At this point, however, based on your decision, you are depriving me of my right to accept or reject any medical procedure without pressure or coercion and preventing me from receiving the medical care that my learned intermediary, Dr. Peter Kaufer, feels, in his medical judgement, is in my best interest, exposing me to harm while violating my nationally and internationally protected Right of Informed Consent.
After World War II, the Chief Justice of the United States restated the law here in what is now commonly known as the Nuremberg Code. It states that the person involved should have the legal capacity to give consent, should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, overreaching or other ulterior forms of constraint or coercion, and should have sufficient comprehension and knowledge of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision.
The tests required are highly unscientific, yield false positives as much as 50% of the time according to a new study, and here is no assurance whatsoever, under current HIPPA statutes, that there is any meaningful privacy possible for these results, whether accurate or not.
The tests are absolutely experimental, as is the decision to use them as a criterion upon which medical and social decisions are being made.
Thus, their use to deny me my needed medical treatment at your facility is both irresponsible and, according to my understanding of the current law, illegal.
This is truly distressing.
I urge you to reconsider your decision.

The American College of Surgeons recommends that COVID-19 PCR testing MAY be recommended. It is NOT required. It MAY be recommended. And then they go on to discuss the fact that the test is inaccurate. So why would it be recommended? And why would that recommendations give anyone the right to wipe out my protected right to decide what medical procedures, including testing, be carried out on my body in the absence of pressure or over-reaching.
Let me be very clear: denying me the opportunity to have needed surgery on my eyes because I will not submit to an inaccurate and RECOMMENDED, not REQUIRED test is a blatant attempt to invalidate my right to medical autonomy and self-determination.
I am Resisting. I am Refusing and I am Raising My Voice.
This is wrong and only when enough people vote with their withdrawal of permission for this kind of medical tyranny will it change.
The test does no good. The results are not private (your medical records can be secretly accessed at any time by multiple agencies and by researchers [sic !]. It is a felony for the staff to tell you that they have been accessed. Sic Semper HIPPA, a system of medical surveillance and control if ever there was one.

What would I like to do? Well, I would like to initiate a major lawsuit on the infringement of my Right of Informed Consent. But that costs money that I do not have, nor does the Natural Solutions Foundation.
